What to look for in any agency

Whether you work with one of our partners or go elsewhere, these are the non-negotiables:

  • SEEDS or ASRM membership. Trade organizations with ethical standards. If an agency isn't a member, ask why.
  • Independent escrow. Your money should be held by a third-party escrow company, not the agency itself. "In-house escrow" is a red flag.
  • Transparent compensation. Base pay, monthly allowance, and every line item should be posted publicly or shared upfront in writing.
  • Independent legal counsel. Your attorney is paid by the intended parents but works for you. You should pick your own attorney from a list, not be assigned one.
  • At least 5 years in operation. New agencies aren't automatically bad, but experience matters when things go wrong.
  • Former surrogates on staff. Not just in marketing copy — actually doing coordinator and case manager work.
  • Honest about cons. Any agency that can't name three things they're not great at is hiding something.

Frequently asked questions

How many surrogacy agencies are there in the US?
Approximately 150–200 as of 2026. We partner with four that meet our criteria for transparency, support quality, and fair compensation. Many others exist but we don't recommend them.
What makes a surrogacy agency reputable?
SEEDS or ASRM membership, independent escrow accounts, publicly transparent compensation, independent legal counsel, at least 5 years in operation, and former surrogates on staff. If any of those are missing, ask why.
How are surrogacy agencies paid?
Agencies charge intended parents an agency fee, typically $25,000–$40,000, separate from surrogate compensation. Surrogates are never charged by the agency.
Can I work with multiple agencies at once?
Generally no. Agencies expect exclusivity during the matching process. You can research multiple before applying, but you'll commit to one when you submit your full application.
Do agencies charge surrogates any fees?
No. Reputable agencies never charge surrogates. If an agency asks you for money or wants to deduct fees from your compensation, walk away.
What if I don't live in a state the agency serves?
